NACHA Adopts Code of Conduct

An Open Letter to All Existing and Potential NACHA Members and Participants in NACHA Programs

NACHA's Board of Directors has approved a Code of Conduct, establishing in writing the standards of behavior expected of NACHA members and participants in our programs. The establishment of a Code was recommended by NACHA's outside legal counsel after a review of our processes for membership and participation.

The Code of Conduct demonstrates NACHA's commitment to fostering exemplary behavior among participants in the ACH Network. The Code will ensure that the business of NACHA in administering the ACH Network can be conducted with the highest levels of integrity, professionalism, and fairness.

The overwhelming majority of members and participants in NACHA's programs contribute positively and constructively to the advancement of the ACH Network. The Code of Conduct is necessary, however, to preserve the reputation and goodwill of the ACH Network, NACHA, and its members and participants against the actions of the few that would impugn the integrity of the Network or NACHA.

The Code of Conduct will be implemented and administered by NACHA's Risk Management Department. Any application for membership or membership renewal, or participation in a NACHA program, committee, work group, conference, etc., will result in a routine review of the applicant or prospective participant. The review process is structured to be diligent, fair and responsive.

In addition to establishing the standards of behavior, the Code of Conduct specifies NACHA's right to disassociate itself from any organization that, in NACHA's opinion, fails to meet the standards and principles stated in the Code. We trust that, with the standards of professionalism and integrity promoted by the Code, that step will not be needed.

The Code of Conduct is posted on NACHA's web site at http://www.nacha.org/NACHA_Issue_Alert_2006-1.pdf. Questions or requests for additional information can be directed to NACHA's Risk Management Department at CodeofConduct@nacha.org.

Sincerely,

Elliott C. McEntee
